This is just not true. The way consensus works is:The miner node works on the most recent valid block.After activation if the most recent block is BIP110 compliant, all nodes accept it (except a URSF version) asvalid and begin to build on that block.If the next block is invalid (by BIP110) it gets rejected by those node and accepted as valid by others.If there is no miner support for BIP110 blocks, that "chain" would stop immediately.If there is some miner support (over 30%) most nodes would accept the BIP110 as the highest chain.If there's overwhelming miner support (over 60%) all nodes would accept BIP110 as the highest chain.The only "split" would be called a dead chain and runs no risk of a late reorg. After 7-8 blocks the race isover basically.
